Terms of service

This document is two agreements in one. Part A is the agreement between you and us about your own user account — you accept it before you get into the service. Part B is the subscription agreement between us and the choir, which the choir’s owner accepts on the choir’s behalf when the choir is created.

Who the agreement is with

Kordinert is a platform for running a choir: member register, season and production planning, activities and attendance, repertoire with a sheet-music archive, practice tracks and a score player, communication, dues, and a mobile app for iOS and Android.

Part A — your user account

Your account is personal. You are responsible for keeping your sign-in to yourself and for what is done from your account. If you belong to several choirs, you use the same account in all of them.

You must be at least 13 to have an account. If you are under 18, the choir records a guardian as your emergency contact. A choir may include children under 13 without the child getting an account of their own.

You can delete your account yourself, at any time, under Min profil. What happens then — and what stays as the choir’s own record — is set out in the privacy policy.

Part A — what you may upload and share

You keep the rights to what you write and upload. You grant us the permission we need to store the content, show it to the people in the choir who are meant to see it, send it in notifications and back it up — nothing beyond that.

You are responsible for having the right to share what you upload. Scores, arrangements and recordings are usually protected by copyright: the choir must have a licence or an agreement for what goes into the sheet-music archive.

Do not upload unlawful content, content that infringes the rights of others, or content meant to harass anyone. Do not attempt to circumvent the service’s access controls, and do not use the service for anything other than running a choir. We may close an account that materially breaches this, with notice where reasonable.

Part B — the subscription agreement with the choir

The customer is the choir as a legal entity. Whoever creates the choir accepts these terms and the data processing agreement on the choir’s behalf, and confirms at the same time that they have the authority to do so.

The processing of members’ personal data is governed by the data processing agreement, under which the choir is the controller and Birget AS the processor. That agreement is part of the contractual relationship and takes precedence over these terms on questions of personal data.

Part B — trial and plans

New choirs get a 30-day free trial with every feature open and no card required. We get in touch before the trial runs out so the choir can pick a plan without being rushed.

The plans carry the same features; the price follows how many members the choir has. We count members with status active, probation or on leave — applicants and members who have left do not count.

A plan’s member figure is a price band, not a block. If the choir grows past it, everything keeps working; we tell you and suggest the next plan. The only thing the figure blocks is buying a plan the choir has already outgrown.

If the choir does not pick a plan when the trial ends, nothing is locked and nothing is deleted. The choir gets a message in the service about where the billing stands, and we follow up. A choir that has put a season of work into Kordinert is not a choir to take the product away from.

Part B — prices and payment

All prices on the website and in the service are stated including Norwegian value added tax. The price on the plan card is the amount the choir pays.

The subscription is paid monthly or annually by card through Stripe. Invoicing can be agreed separately; the invoice is then sent outside the service. Upgrades take effect immediately and are pro-rated; downgrades take effect at the end of the period.

Price changes are announced at least one month before they take effect and apply from the next renewal. A choir that disagrees may cancel before the change takes effect.

The dues a choir collects from its own members are the choir’s business. We produce the document and email it when the choir asks us to, but we are not a party to the claim and we handle no dues payment.

Part B — how the agreement is concluded

The agreement is concluded electronically. A choir is created in a wizard whose last step is a checkbox accepting the terms and the data processing agreement; the agreement is concluded when that step completes. Buying a plan happens on a separate payment page, and the order is confirmed on screen and in Stripe’s receipt.

Until the last step, every detail can be changed by going back in the wizard, and a mistake is corrected by editing the field. After the choir is created, the details are changed under Settings.

We record which version of the terms and of the data processing agreement was accepted, by whom, when and in which language. The documents are always available here on the website in the version in force. The agreement can be concluded in Norwegian or English.

Part B — the choir’s data

The choir owns its own data. The member list and the dues ledger can be exported as CSV by the choir itself at any time, and the choir can ask us for a complete copy of its data — including before deletion on termination.

We do not use a choir’s data for anything other than delivering the service to that choir. We do not sell it, and we do not use it to train models.

Part B — termination and deletion

The choir may cancel at any time. Cancelling at period end lets the subscription run out the period already paid for; cancelling immediately ends it at once.

After cancellation the choir’s data sits untouched for 90 days. If the choir changes its mind within that window it writes to support@kordinert.no and we reopen it — there is no button in the product that does this. When the 90 days are up the choir is archived, reopening is no longer possible, and the data is deleted in a subsequent clean-up.

We may terminate with three months’ notice, or with immediate effect on material breach. If we terminate, the choir gets the chance to retrieve its data first.

Part B — availability and changes to the service

We work to keep the service available, but we give no uptime guarantee and we sell no service level agreement. Planned maintenance is announced in the service.

We develop the service continuously. New features arrive and features may change. If we remove something a choir depends on, we give at least one month’s notice in the service.

Liability

The service is provided as-is. We are not liable for indirect losses, lost profit, or loss arising because the choir kept no backup of material it depends on.

Our total liability is limited to what the choir has paid for the service in the preceding twelve months. The limitation does not apply in cases of gross negligence or intent, and nothing in these terms limits liability that cannot be excluded under Norwegian law.

Changes to the terms, governing law and disputes

We may update these terms. Material changes are announced in the service at least one month before they take effect, and if we change something that affects what was accepted we ask for acceptance again. The version at the top of the page tells you which text is in force.

The agreement is governed by Norwegian law. Disputes are to be settled amicably; failing that, Oslo District Court is the venue. If you are a consumer you may always use your own ordinary venue, and you may bring the matter to the Norwegian Consumer Authority.
